Your Legal Safeguarding Responsibilities

Current legislation relating to safeguarding includes:

  • The Care Act 2014

Local services such as councils, the NHS and the police must work together to make policies that protect adults that could be at risk in their area.

  • The Mental Capacity Act 2005

Essential knowledge for anyone working in a profession in which they are likely to have to make judgements about the mental capacity of someone else. It’s designed to protect and empower individuals who may lack the mental capacity needed to make decisions for themselves.

  • The Human Rights Act 1998

The act containing the list of all 16 rights which every person in the UK has.

  • The Safeguarding Vulnerable Groups Act 2006

This requires all people working with vulnerable groups to undergo a vetting process to check for any criminal sanctions.

  • The Children’s Act 2008

The main purpose of this Act was to empower local authorities and other organisations so that they could better regulate interventions in the interests of vulnerable children.

  • MCA DoLS

This legislation was introduced to stop deprivations of liberty from happening without proper procedures and safeguards being in place.
